## The short version

Search for 'CBD oil India' and you will find hundreds of products — some made by licensed Ayurvedic manufacturers, many not. The difference is not just paperwork. It decides whether a product is legal to sell, whether its contents have been checked, and whether a doctor is part of the process.

## Is CBD legal in India? The short answer

Search for 'CBD oil India' and you will find hundreds of products — some made by licensed Ayurvedic manufacturers, many not. The difference is not just paperwork. It decides whether a product is legal to sell, whether its contents have been checked, and whether a doctor is part of the process.

This guide explains what an AYUSH licence is, how to verify one, what to look for on a label and lab report, and why unlicensed or imported CBD carries real risks.

Cannabis leaf (Vijaya) and seeds are excluded from the definition of 'cannabis (hemp)' under the NDPS Act, 1985, which prohibits the flowering tops (ganja) and resin (charas). Ayurvedic medicines made from the leaf are regulated under the Drugs and Cosmetics Act, 1940 and need an AYUSH manufacturing licence.

So CBD and THC from the leaf can be legally supplied as an AYUSH-licensed Ayurvedic medicine, used with a prescription under medical supervision. Recreational cannabis is illegal. ## What is an AYUSH licence?

AYUSH stands for Ayurveda, Yoga and Naturopathy, Unani, Siddha, Sowa-Rigpa and Homoeopathy. Under the Drugs and Cosmetics Act and its rules, a company that manufactures Ayurvedic, Siddha or Unani medicines must hold a manufacturing licence issued by the State Licensing Authority (usually the state's AYUSH or drug control department).

A licence is granted for specific products and premises, and the manufacturer is expected to follow Good Manufacturing Practices and labelling rules. Vijaya medicines must also carry a caution that they are to be taken under medical supervision.

Calmosis products are manufactured under AYUSH Licence No. MPI25E/23/1117, issued by the Madhya Pradesh AYUSH Department.

## How to verify an AYUSH licence number

- Find it on the label. A licensed Ayurvedic medicine should print the manufacturing licence number, the manufacturer's name and full address, and ideally the issuing state.
- Match the names. The company name on the label, website and invoice should match the licence holder (or clearly name the licensed manufacturer if it is made under contract).
- Check with the authority. You can contact the State Licensing Authority (AYUSH/drug control department) of the issuing state to confirm a licence is valid and covers that product. Many states now process AYUSH licensing through the Ministry of Ayush's online systems.
- Ask the brand. A genuine manufacturer will happily share its licence details and product approval. Vague answers are a warning sign.

## Labelled cannabinoid content

A trustworthy Vijaya product tells you what is inside and how much. Look for the percentage or milligram amount of Vijaya extract per bottle, per ml or per gummy, a full ingredient list with botanical names, and batch number with manufacturing and expiry dates.

Be cautious of vague claims such as 'high-strength' or 'premium potency' without numbers, or very large milligram figures with no explanation of what they refer to.

## Lab reports and COAs

A Certificate of Analysis (COA) is a lab report for a specific batch. For cannabis-based products it should ideally show the cannabinoid profile (such as THC and CBD content) and screening for contaminants like heavy metals, pesticides and microbial load.

When you read a COA, check that the batch number matches your product, that the lab is named and identifiable, that the date is recent, and that the results match what the label claims. Ask the brand for the COA if it is not published.

## Risks of imported or unlicensed CBD

- Legal risk — products sold outside the AYUSH framework may not be legal to sell or possess, and importing cannabis products without authorisation can breach Indian law.
- Unknown contents — without testing, a product may contain much more or much less CBD or THC than claimed, or none at all.
- Contaminants — untested oils may contain pesticides, solvents or heavy metals.
- No medical oversight — skipping a doctor means nobody checks for interactions with your medicines or conditions that make cannabis unsuitable.
- No accountability — if something goes wrong, there may be no traceable manufacturer to contact.

## Red flags when buying CBD online

- No licence number, manufacturer name or address on the pack or website.
- Sold only through social-media messages, with payment to a personal account.
- Claims that a product cures anxiety, cancer, diabetes or any other disease — such claims are not permitted for Ayurvedic medicines.
- No prescription or doctor consultation required for an oral cannabis product.
- Descriptions that suggest recreational use or a 'high'.
- Very large potency numbers with no lab report to back them up.
- No way to contact the company by phone or email.

## Hemp seed oil is not CBD oil

A common source of confusion: hemp seed oil, sold in kitchens and cosmetics, is pressed from the seeds and contains little or no CBD or THC. It is a useful food oil but should not be marketed as a calming cannabinoid product.

If a 'CBD oil' lists only hemp seed oil as its ingredient, it is unlikely to contain meaningful cannabinoids.

## Frequently asked questions about AYUSH-licensed vs unlicensed CBD

What does AYUSH approved CBD oil mean?It usually means the oil is an Ayurvedic medicine made by a manufacturer holding an AYUSH manufacturing licence from a State Licensing Authority. The licence number should be printed on the label.

How can I check if a CBD brand is AYUSH licensed?Find the manufacturing licence number and manufacturer's address on the label, then confirm it with the issuing state's AYUSH or drug licensing authority, or ask the brand for its licence details.

What is ayush cannabis? It is a common way of describing Ayurvedic cannabis (Vijaya) leaf medicines made under an AYUSH licence, as opposed to recreational cannabis, which is illegal.

What is a COA?A Certificate of Analysis is a batch-specific lab report. For cannabis products it should show cannabinoid content and contaminant screening, and its batch number should match your product.

Is it safe to buy imported CBD oil online? It carries legal and quality risks: it may not be legal to import or sell, its contents may not match the label, and no doctor is involved. A licensed Indian Ayurvedic product used with a prescription is the safer route.

Do AYUSH CBD products need a prescription?Yes. Vijaya medicines for oral use are meant to be taken under the supervision of a registered medical practitioner. Calmosis includes a free AYUSH doctor consultation with every order.

## Talk to an AYUSH doctor before you start

Vijaya medicines are sold on prescription. Every Calmosis order includes a free online consultation with an AYUSH-licensed doctor, who checks whether a product suits you, how much to take and whether it could interact with anything you already use.

Co-founder, Calmosis

I co-founded Calmosis in Bengaluru in 2023, an AYUSH-certified Ayurvedic wellness brand built around Vijaya, the classical name for cannabis in Ayurveda. I wanted to take a misunderstood plant out of the shadows and make it approachable, pairing traditional Ayurvedic knowledge with honest, plain-spoken guidance and a free doctor consultation, so people can decide what is right for them. I write about sleep, calm, and everyday wellness without hype or false promises, and I point anyone with a specific health question to a qualified physician.
